Terms of Service

1. Introduction

Welcome to LeCoach. These Terms of Service ("Terms") govern your use of the LeCoach service. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use LeCoach.

Provider: LeCoach App is a trade name of Gyn Health App B.V., registered office at Achtseweg Zuid 159R, 5651 GW Eindhoven, The Netherlands, registered with the Dutch Chamber of Commerce under number 98792105 ("LeCoach", "we", "us").

These Terms cover the whole service: the website at lecoach.app, the web application, and the LeCoach apps for iOS and Android. The mobile apps are a different way to reach the same service.

We may update these Terms. If a change is material we will notify you by email or in the application before it takes effect. Continued use after that constitutes acceptance.

2. What LeCoach is

LeCoach is an AI-powered endurance coaching platform for cyclists and runners. It provides:

• Personalised, adaptive training plans and generated workouts
• AI coaching conversations, briefings and reviews
• Analysis of your training, wellness and performance data
• Two-way synchronisation with third-party platforms such as Intervals.icu
• Scheduling, tracking and reporting tools

LeCoach is a software tool. It is not a human coach, a medical service, a medical device, or a substitute for professional advice of any kind.

3. Your account

To use LeCoach you must create an account. You agree to:

• Be at least 18 years old
• Provide accurate registration and profile information
• Keep your credentials secure and not share your account
• Tell us immediately about any unauthorised access
• Take responsibility for all activity under your account

Accurate physiological data (weight, FTP, threshold pace, zones, health status) is your responsibility. Coaching output is only as good as the information you give it.

4. Subscriptions, trial and payment

4.1 Free trial

New accounts get a 14-day free trial of LeCoach Pro. No payment is taken during the trial, and the trial does not convert into a paid subscription on its own: you choose whether to subscribe.

4.2 Prices and renewal

• LeCoach Pro is offered monthly or annually. Current prices are shown on our pricing page and at checkout before you pay.
• Prices are in euro (EUR) and include VAT where applicable. Your local taxes are calculated at checkout.
• Subscriptions renew automatically at the end of each billing period until you cancel.
• We will give you at least 30 days' notice by email before any price increase applies to your subscription. You may cancel before it takes effect.

4.3 Where you buy

Subscriptions are purchased on the LeCoach website, not through the Apple App Store or Google Play. Payments are processed by Stripe. Apple and Google are not parties to your purchase, do not process the payment, and have no role in billing, refunds or subscription management. A subscription bought on the web unlocks the full service everywhere, including in the mobile apps.

4.4 Cancelling

You can cancel at any time from Settings, through the billing portal. Cancellation takes effect at the end of the period you have already paid for; you keep full access until then. We do not pro-rate partial periods.

4.5 Right of withdrawal and refunds

If you are a consumer in the EU, EEA or UK, you have a statutory right to withdraw from a distance contract within 14 days. By starting your paid subscription you expressly request that we begin providing the service immediately and acknowledge that you lose the right of withdrawal once the service has been fully performed for that period.

Apart from that statutory right, all payments are final and non-refundable, including for unused time, forgotten renewals or dissatisfaction with AI output. Nothing here limits your mandatory statutory rights.

4.6 Failed payments

If a payment fails, we retry and give you a short grace period (currently 7 days) to update your details. If payment still fails, access to paid features is suspended until the balance is settled.

4.7 Discounts and referral credits

Discounts, promotional rates and referral credits are granted at our discretion, have no cash value, cannot be exchanged, transferred or paid out, and may expire. We may withdraw or reclaim credits obtained through fraud, self-referral, fake accounts or other abuse, and may suspend accounts involved.

5. Artificial intelligence: what you must understand

LeCoach's coaching is generated by artificial intelligence. Please read this section carefully, because it defines what you can and cannot expect.

• AI output is produced by statistical language models. It can be wrong, incomplete, outdated, internally inconsistent, or confidently mistaken. Plausible-sounding output is not the same as correct output.
• No human reviews the output before you see it. Training plans, workouts, analyses, numbers and recommendations are generated automatically.
• AI may misread your data, misinterpret context, invent detail that is not in your history ("hallucinate"), or produce training loads that are inappropriate for your fitness, health, schedule or recovery state.
• You must not rely on LeCoach as medical, physiotherapeutic, nutritional, psychological, pharmacological or any other professional advice. It is training guidance only.
• You remain in control and responsible for every session you do. Always apply your own judgment. If a workout feels wrong, unsafe or beyond your current capacity, do not do it. Adjust it, skip it, or ask a qualified professional.
• Stop exercising immediately and seek medical help if you experience chest pain, breathlessness beyond normal exertion, dizziness, fainting, irregular heartbeat, unusual pain, or any symptom that worries you. No plan matters more than that.
• We use third-party AI providers (including Google and OpenAI) and may change them. AI availability, response time, quality and usage limits may vary, and AI features may be rate-limited, temporarily unavailable, or changed without notice.
• Fitness metrics such as FTP, CTL, ATL, form, readiness and zone or execution scores are estimates derived from models, not measurements, and should be treated as directional indicators.
• LeCoach makes no diagnostic claim. It does not detect, diagnose, monitor, treat or prevent any disease or medical condition, and is not a medical device under any regulation.

By using LeCoach you acknowledge these limitations and accept that you use AI-generated guidance at your own risk and discretion.

6. Medical disclaimer and assumption of risk

IMPORTANT - PLEASE READ CAREFULLY.

• LeCoach is not a medical device or medical service and gives no medical advice.
• Consult a qualified physician before starting, resuming or significantly changing any training programme, particularly if you have or suspect any cardiovascular, respiratory, metabolic or musculoskeletal condition, are pregnant or postpartum, are recovering from illness, injury or surgery, or are over 40 and previously inactive.
• By using LeCoach you confirm you are medically fit to undertake the training you choose to do.
• Endurance training carries inherent risks, including muscle and joint injury, overtraining, heat illness, dehydration, road traffic accidents, cardiac events and, in rare cases, death. You knowingly and voluntarily assume all of those risks.
• Never disregard or delay professional medical advice because of something LeCoach told you.
• In an emergency, contact your local emergency services immediately.

7. Health and fitness data

By using LeCoach you understand and agree that:

• We collect and process your training, wellness and health-related data to provide the service, as described in our Privacy Policy
• You give explicit consent for this processing, and can withdraw it by deleting your data or your account
• This data may be sent to our AI providers to generate coaching output, and may be synced with platforms you connect
• Authorised LeCoach administrators may view your account data in read-only mode for support, debugging and service quality
• You may export or delete your data at any time

8. Third-party integrations

LeCoach integrates with services such as Intervals.icu. You acknowledge that:

• You must comply with the terms of any platform you connect
• We are not responsible for the availability, accuracy, functionality or security of third-party services
• Data synced to a third party is then also governed by that party's terms and privacy policy
• We store your connection credentials in encrypted form and use them only to sync your own data
• A third party may change or withdraw its API at any time, which may reduce or remove integration features without this being a breach by us

9. Acceptable use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' data
• Interfere with, overload or disrupt the service, or circumvent usage limits, paywalls or rate limits
• Scrape, reproduce, resell, sublicense or redistribute any part of the service or its output as a competing product
• Use automated systems to access the service without our written permission
• Use the AI coach to generate unlawful, harmful, abusive or deliberately misleading content, or to extract our prompts, models or underlying systems
• Create accounts to abuse trials, discounts or the referral programme
• Submit false or misleading information

10. Intellectual property

The LeCoach software, design, brand, prompts, coaching methodology and all related content are owned by us and protected by intellectual property law. You receive a limited, personal, non-exclusive, non-transferable, revocable licence to use the service for your own training.

You keep ownership of your own data and content. You grant us a worldwide, royalty-free licence to host, process, analyse and display it strictly to operate and improve the service for you. Training plans and workouts generated for you are yours to use personally; the underlying system that produced them is not.

11. Availability and changes to the service

We aim for a reliable service but do not guarantee uninterrupted availability. Maintenance, third-party outages, AI provider incidents and technical failures can interrupt the service. We may modify, add, suspend or discontinue features at any time. If we discontinue the paid service entirely, we will refund the unused portion of any prepaid period.

12. Disclaimer of warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, accuracy or non-infringement.

We do not warrant that the service will be error-free, that AI output will be accurate or suitable for you, or that using LeCoach will improve your fitness, performance or race results. Training outcomes depend on many factors outside our control and are never guaranteed.

13. Limitation of liability

• We are not liable for any injury, illness, health consequence, overtraining, accident or death arising from training you choose to undertake, whether or not it followed LeCoach guidance.
• We are not liable for decisions you make based on AI-generated output, estimates or analyses.
• We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, opportunity, competition results, training history or data.
• Our total aggregate liability for all claims is limited to the amount you actually paid us in the 12 months before the event giving rise to the claim.
• This limitation applies to all claims, whether in contract, tort, statute or otherwise.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold LeCoach, Gyn Health App B.V. and its directors and staff harmless from any claim, liability, damage or reasonable cost arising from your breach of these Terms, your misuse of the service, your violation of any law or third-party right, or any injury or loss resulting from training decisions you made. This does not apply to claims caused by our own negligence or wilful misconduct.

15. Suspension and termination

You may stop using LeCoach and delete your account at any time from Settings. We may suspend or terminate access if you breach these Terms, abuse the service, or use it unlawfully. Where a breach is minor and fixable, we will normally warn you first.

If we terminate your account without cause, we refund the unused portion of any prepaid period. If we terminate for breach, no refund is due. On termination, your right to use the service ends and your data is deleted in line with our Privacy Policy; you may request an export beforehand.

16. Apple App Store terms

These clauses apply when you use LeCoach on an Apple device, and Apple requires them:

• These Terms are between you and LeCoach only, not with Apple. Apple is not responsible for the app or its content.
• Your licence to use the iOS app is a non-transferable licence to run it on Apple-branded devices you own or control, subject to Apple's Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid to Apple for the app (which for LeCoach is zero, as subscriptions are bought on our website). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• LeCoach, not Apple, is responsible for any claims relating to the app, including product liability, legal or regulatory non-compliance, and consumer protection or privacy claims.
• LeCoach, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

17. Google Play terms

When you use LeCoach on Android, these Terms are between you and LeCoach only, not with Google. Google is not responsible for the app or its content, provides no support for it, and is not a party to any subscription you purchase from us. Your use of the app is also subject to the Google Play Terms of Service.

18. Governing law and disputes

These Terms are governed by the laws of the Netherlands, and disputes will be submitted to the competent courts in Amsterdam, the Netherlands.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may also bring proceedings in the courts of that country.

EU consumers may also use the European Commission's Online Dispute Resolution platform. We would much rather you emailed us first: most issues are resolved in a day.

19. General

• If any provision is held invalid or unenforceable, the rest remains in force and the invalid provision is replaced by the closest valid equivalent.
• Failure to enforce a provision is not a waiver of it.
• You may not transfer your account or these Terms. We may transfer them as part of a merger, acquisition or reorganisation.
• These Terms and the Privacy Policy form the entire agreement between you and us regarding the service.
